By accessing or using the End of Watch Foundation (EOWF) website (eowf.org), participating in EOWF events, purchasing EOWF merchandise, or making donations to EOWF, you agree to be bound by these Terms and Conditions ("Terms"). Please read these Terms carefully before using our services.
1. Acceptance of Terms:
By using our website, participating in events, making purchases, or donating, you signify your acceptance of these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.
2. Website Use:
You may use our website for lawful purposes only.
You agree not to use our website in any way that could damage, disable, overburden, or impair it or interfere with any other party's use and enjoyment of the website.
All content on the EOWF website, including text, graphics, logos, images, and software, is the property of EOWF or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or display our content without our prior written consent.
3. Event Registration and Participation:
Registration for EOWF events may require you to provide certain personal information and agree to specific event rules and waivers.
EOWF reserves the right to refuse or cancel any registration at its discretion.
Participants are responsible for ensuring they are physically and mentally capable of participating in events and for adhering to all safety guidelines and instructions provided by EOWF staff and volunteers.
Refund and Cancellation Policy: Event registrations can be cancelled for a full refund (less a $50 admin fee) within 10 days of purchase and at least 30 days before the event. Refunds may be available for cancellations made further out. No refunds for cancellations within 30 days of the event. See our full policy at eowf.org/refunds-cancellation-policy.
4. Donations:
All donations made to EOWF are voluntary and non-refundable, except as explicitly stated in our Refund and Cancellation Policy regarding event cancellations initiated by EOWF.
EOWF reserves the right to use donations at its discretion to support its mission.
5. Merchandise Purchases:
The purchase of merchandise through our website is subject to availability and our shipping policies.
We reserve the right to change the prices of our merchandise at any time.
Returns and Exchanges: Unopened online purchases can be returned within 30 days of receipt with proof of purchase. In-person purchases are not returnable. See our full policy at eowf.org/refunds-cancellation-policy.
6. User Content:
If you submit any content to our website (e.g., comments, testimonials), you grant EOWF a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
You represent and warrant that you own or otherwise control all of the rights to the content you submit and that the content is accurate, not misleading, and does not violate these Terms or the rights of any third party.

Our website may contain links to third-party websites. These links are provided for your convenience only, and EOWF does not endorse or assume any responsibility for the content, privacy policies, or practices of these websites. You access these websites at your own risk.
8. Disclaimer of Warranties:
Our website and services are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
EOWF does not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Limitation of Liability:
To the fullest extent permitted by applicable law, EOWF and its affiliates, officers, directors, employees, agents, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to your use of our website, participation in our events, purchase of merchandise, or donations, even if EOWF has been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or your use of our services shall not exceed the amount you paid to EOWF, if any, in the twelve (12) months preceding the event giving rise to the liability.

You agree to indemnify, defend, and hold harmless EOWF and its affiliates, officers, directors, employees, agents, and volunteers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms or your use of our website or services.
11. Governing Law:
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
12. Dispute Resolution:
Any dispute arising out of or relating to these Terms shall be resolved through good faith negotiation. If the parties are unable to resolve the dispute through negotiation, it shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

EOWF reserves the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued use of our website or services after the posting of revised Terms constitutes your acceptance of the changes.
